Bryan Kohberger Rips State Over Evidence in Murder Case (video)

They contend that this gap could demonstrate that Kohberger was not physically present at the crime scene when the murders occurred. Central to this argument is the request for “timing advance” records from AT&T, which they claim would provide accurate data on Kohberger’s phone location during the critical time period.

The defense maintains that these records not only exist but were available to law enforcement at the time of the murders. In court documents, they have accused the state of misleading the court by suggesting that the timing advance records did not exist until after the murders. Prosecutors have countered this by asserting they could not have accessed the records because Kohberger was not identified as a suspect until December 19, 2022, and that AT&T retained such records for only seven days prior to June 2023.

The defense’s cell phone expert has claimed that the state’s failure to secure these records indicates a deliberate attempt to mislead, suggesting that the prosecution is concealing evidence that could significantly impact the case. This expert argues that the records could corroborate Kohberger’s alibi of being at a park around the time of the murders, as well as clarify the direction in which Kohberger’s vehicle was traveling.

Furthermore, the defense argues that Kohberger’s alleged psychological conditions, including autism spectrum disorder and obsessive-compulsive disorder, should be considered in the trial. They claim these conditions could affect his ability to commit the crimes in the manner described by the prosecution. The defense has indicated that Kohberger exhibits behaviors consistent with these disorders, which could help explain his actions and demeanor.

In a related development, the state has prepared to introduce evidence suggesting that Kohberger’s cell phone was within a 100-meter radius of the crime scene on multiple occasions leading up to the murders.
